TERMS AND CONDITIONS OF USE

1. INTRODUCTION
Welcome to Kolab Global Pty Ltd (“Kolab Global,” “we,” “our,” or “us”). These Terms and Conditions (“Agreement”) govern your access to and use of the website www.kolab.shop (the “Site”) and all products and services offered by Kolab Global.
By accessing, using, or purchasing from the Site, you acknowledge that you have read, understood, and agreed to be bound by this Agreement. If you do not agree to these Terms and Conditions, do not use this Site.
2. DEFINITIONS
For the purposes of this Agreement:
- “Customer” or “you” refers to any individual or entity purchasing from or using the Site.
- “Products” refers to protective equipment cases, accessories, and related items sold by Kolab Global.
- “Business Days” refers to weekdays excluding Australian public holidays.
3. MODIFICATIONS TO TERMS
Kolab Global reserves the right to modify, update, or replace any part of this Agreement at its discretion, without prior notice. Changes will take effect immediately upon posting on the Site. Your continued use of the Site constitutes acceptance of any modifications.
4. ORDERING & ACCEPTANCE OF TERMS
4.1 Order Process
(a) Orders placed through the Site constitute an offer to purchase the selected Products.
(b) Kolab Global reserves the right to accept or reject any order, in whole or in part, at its sole discretion.
(c) Upon order acceptance, a confirmation email will be sent to the email address provided at checkout.
4.2 Payment Terms
(a) Payment must be made in full at the time of purchase using approved payment methods.
(b) Prices are listed in AUD and include applicable taxes unless otherwise stated.
(c) Kolab Global reserves the right to change prices at any time without notice.
4.3 Cancellation Policy
(a) Orders may only be canceled before shipment. Once an order has been dispatched, it is subject to our Returns Policy (see Section 6).
(b) Kolab Global reserves the right to cancel any order due to suspected fraud, pricing errors, or product unavailability. If an order is canceled by us, you will receive a full refund.
5. SHIPPING & DELIVERY
5.1 Shipping Terms
(a) Kolab Global ships worldwide, subject to carrier availability and import/export restrictions.
(b) Shipping fees are calculated at checkout and vary based on destination, weight, and shipping method selected.
5.2 Delivery Timeframes
(a) Estimated delivery times are provided at checkout but are not guaranteed.
(b) Kolab Global is not responsible for delays caused by carriers, customs, or force majeure events.
5.3 Risk of Loss
(a) Title and risk of loss for Products pass to the Customer upon delivery by the carrier.
(b) Kolab Global is not liable for lost, stolen, or damaged packages after delivery. Customers should contact the carrier for resolution.
6. WARRANTY POLICY
6.1 LIMITED LIFETIME WARRANTY
Kolab Global warrants to the original purchaser that its protective hard cases will be free from defects in materials and workmanship for the lifetime of the product. This warranty applies only to the case shell and does not cover foam inserts, wheels, handles, latches, or other accessories, which are subject to normal wear and tear.
If a Kolab case is found to be defective under normal use, Kolab Global will, at its sole discretion, repair or replace the case free of charge. Proof of purchase from an authorized dealer is required to validate warranty claims.
6.2 EXCLUSIONS & LIMITATIONS
This warranty does not cover:
- Misuse, abuse, or neglect (e.g., improper storage, modifications, or exposure to extreme conditions).
- Accidental damage, including drops, impacts, or excessive force.
- Cosmetic wear, such as scratches, dents, or fading.
- Damage to contents stored within the case.
- Third-party modifications or unauthorized repairs.
Kolab Global is not liable for any incidental, consequential, or special damages arising from the use of its products, including loss of equipment or data stored in the case.
6.3 HOW TO MAKE A WARRANTY CLAIM
To file a claim, contact support@kolab.shop with:
- Proof of purchase
- Photos of the defect
- A brief description of the issue
Kolab Global will assess the claim and provide instructions for return or replacement. The customer is responsible for shipping costs to Kolab Global; return shipping for repaired or replaced cases will be covered by Kolab Global within the country of original purchase.
This Limited Lifetime Warranty is non-transferable and only applies to products purchased from authorized Kolab Global dealers.
7. RETURNS & REFUNDS
7.1 Return Policy
(a) Products may be returned within 15 days from the date of delivery for a refund or exchange, provided they are in original condition, unused, and in original packaging.
(b) Customers must request a return authorization before sending any product back. Unauthorized returns may be refused.
7.2 Non-Returnable Items
The following items are non-returnable:
- Custom or personalized products.
- Items marked as final sale.
- Products that show signs of use, damage, or alteration.
7.3 Refund Process
(a) Products may be returned within 15 days from the date of delivery for a refund or exchange, provided they are in original condition, unused, and in original packaging.
(b) Customers must request a return authorization before sending any product back. Unauthorized returns may be refused.
(c) We do not offer a refund for a change of mind. An exchange or store credit may be approved depending on the issue.
8. LIMITATION OF LIABILITY
8.1 No Consequential Damages
To the maximum extent permitted by law, Kolab Global shall not be liable for any indirect, incidental, consequential, or punitive damages arising from the use of its products, including but not limited to loss of profits, data, or business opportunities.
8.2 Maximum Liability
Kolab Global’s total liability, whether in contract, tort, or otherwise, shall not exceed the amount paid for the product giving rise to the claim.
8.3 Indemnification
You agree to indemnify and hold Kolab Global harmless from any claims, losses, liabilities, and expenses arising from your misuse of our products or violation of this Agreement.
9. INTELLECTUAL PROPERTY RIGHTS
9.1 Ownership
All content, trademarks, logos, images, designs, text, and intellectual property displayed on Kolab Global’s website and products (collectively, the “Intellectual Property”) are the exclusive property of Kolab Global or its licensors. Unauthorized use, reproduction, or modification of any Intellectual Property is strictly prohibited.
9.2 License & Restrictions
Kolab Global grants you a limited, non-exclusive, and non-transferable license to access and use our website and products for personal, non-commercial purposes only. You may not:
(a) Copy, distribute, or exploit any Intellectual Property without prior written consent.
(b) Reverse-engineer, decompile, or disassemble any software or technology associated with our products.
(c) Use our trademarks or branding without explicit authorization.
10. PRIVACY POLICY
10.1 Data Collection
Kolab Global collects and processes personal data in accordance with its Privacy Policy. By using our website and services, you consent to the collection, use, and sharing of your data as outlined in our Privacy Policy.
10.2 Third-Party Services
We may use third-party services for payment processing, analytics, and other functions. Kolab Global is not responsible for how these third parties handle your data.
10.3 Security
We take reasonable measures to protect your personal information but cannot guarantee complete security. You acknowledge that transmitting data over the internet carries inherent risks.
11. DISPUTE RESOLUTION & GOVERNING LAW
11.1 Governing Law
This Agreement shall be governed by and interpreted in accordance with the laws of [Victoria, Australia, without regard to conflict of law principles.
11.2 Arbitration & Mediation
(a) Any disputes arising from this Agreement shall first be attempted to be resolved through good faith negotiations or mediation.
(b) If mediation fails, disputes shall be resolved through binding arbitration in Melbourne, conducted under the rules of Australian Centre for International Commercial Arbitration.
11.3 Class Action Waiver
You agree that any dispute resolution will be conducted on an individual basis and not as part of a class action or collective proceeding.
12. MISCELLANEOUS
12.1 Severability
If any provision of this Agreement is found to be unenforceable, the remainder of the Agreement shall remain in full force and effect.
12.2 Amendments
Kolab Global reserves the right to update these Terms and Conditions at any time. Continued use of our products and website after changes constitute acceptance of the revised terms.
